TERMS OF USE

MWA Capital Pte. Ltd., (“MWA”, “Company”, “we”, “us”, “our”) means each and every current and future affiliate of MWA Capital Pte Ltd. The Company’s Terms of Use (these “Terms of Use”) governs each user’s use of the website at www.mwacapital.com.sg (the “Website”) as well as use of the mobile application developed by us (the “App”) and any services provided by us (together, the “Services”). The Services are provided by us, a company incorporated under the laws of the Republic of Singapore, licensed and registered with the Ministry of Law as a licensed moneylender, having its registered address at: 3 Phillip Street, Royal Group Building, #13-01, Singapore 048693.

By using the Services in any manner, including but not limited to visiting or browsing the Website and/or the App, you agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, our Privacy Policy or any other documents referred to by these Terms of Use, you are not permitted to, and should not use the Services. You also undertake to familiarise yourself with and comply with these Terms of Use and Privacy Policy relevant to your use of the Website, the App and the Services provided (as may be amended from time to time). Each time you use the Services, you represent, warrant and undertake (i) to accept, comply with and be bound by these Terms of Use and (ii) to comply with all applicable laws, regulations and rules in relation to your access to and use of the Website, the App and the Services.

 

All loans are subject to review and approval. Annual percentage rates (APRs) for our loans vary, depending on various criteria. Eligibility to receive a loan is not guaranteed, and extending a loan requires that a sufficient pool of liquidity is available to fulfil your request and that you meet other conditions. Borrowers must be individuals resident in Singapore, holding either Singapore citizenship, Singapore permanent residency, a valid work pass, or a long term visit pass, and must be at least 21 years old at the time of application for a loan. Borrowing against collateral entails risk and may not be appropriate for your needs. MWA does not provide legal or tax advice. Please consult your advisor before applying for a loan.

 

GENERAL

You acknowledge that you have read and understood these Terms and that you are at least 21 years old.

 

MWA reserves the right to refuse use of the Services to anyone and to reject, cancel, interrupt, remove or suspend any application, transaction or services at any time and without notice for any reason without liability.

 

You may use the Website, the App and the Services only for lawful purposes and in accordance with these Terms of Use. You agree not:

 

a. to use the Website, the App and the Services in any way that violates any applicable law, legislation or regulation;

 

b. to use the Website, the App and the Services for any unauthorised, fraudulent, or malicious purpose;

 

c. to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Website, the App and the Services, or which, as determined by us, may harm the Company or users of the Website and/or the App or expose them to liability;

 

d. to use the Website, the App and the Services in any manner that could disable, overburden, damage, or impair the site;

 

e. to use any robot, spider, or other automatic device, process, or means to access the Website and/or the App for any purpose, including monitoring or copying any of the materials on the Website;

 

f. to access systems, data or information not intended by us to be made accessible to a user;

 

g. to obtain or attempt to obtain any materials or information through any means not intentionally made available by us; or

 

h. to use the Website, the App and the Services for any use other than the purpose for which it was intended.

 

For example, you will not use the Website, the App and the Services in connection with money laundering or the financing of terrorism.

 

You acknowledge that you have read through the Notes to Borrowers When Obtaining Loans from Licensed Moneylenders issued by the Ministry of Law. You acknowledge that you are taking this loan in your personal capacity and solely for your own benefit.

 

USE OF COOKIES

The Services, the Website and the App may use data collection devices such as “cookies” and other technologies such as pixel tags and web beacons to personalise your online experience, help analyse the flow of the Website and/or the App and measure promotional effectiveness. "Cookies" which are small files that reside on your computer's hard drive generally contain an anonymous unique identifier and are accessible only by the website that placed them there and not by any other website. We may offer features that are only available through the use of a “cookie”.

 

We also use cookies to recognise you when you login to the Website and/or the App and to store your preferences and customised settings. Cookies may also help us provide you with information based on your interests.

IDENTITY VERIFICATION

At our request, you agree to provide us with the information we request for the purposes of identity verification and the detection of money laundering, terrorist financing, fraud, or any other financial crime and permit us to keep a record of such information, subject to applicable laws, legislation or regulations.

 

By submitting an application through the Website and/or the App, you confirm the following:

 

a. all the details provided by you are accurate and complete;

 

b. all original documents provided by you are authentic, in full force and effect and has not been terminated, suspended or amended;

 

c. there is no other information or documents other than those which have been disclosed by you that would require examination for any loan application;

 

d. there is no law or contractual obligation which would prevent you from performing the terms of this loan; and

 

e. you have not been adjudged to be a bankrupt under any applicable law in Singapore or in any other jurisdiction in the world.

 

INTELLECTUAL PROPERTY

MWA is the owner or the licensee of all intellectual property rights in the Website and the App, and in the material published by it. Such content include at any given time text, graphics, logos, icons, images, sound clips, video clips and data compilations, and together with the Website and the App's page layout, underlying code and software. All such rights are reserved. You agree to respect all intellectual property rights, including but not limited to copyright, trademarks, trade names (whether registered or not) contained or displayed on the Website and the App or which you gain access to in connection with using the Services.

 

RELIANCE ON INFORMATION POSTED

We do not warrant the accuracy, completeness, or usefulness of any information presented on or through the Website and the App. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Website and/or the App, or by anyone who may be informed of any of its contents. We do not guarantee that the the Website, the App or any content on them, will always be available or uninterrupted. INDEMNIFICATION

You hereby indemnify to the fullest extent MWA from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms of Use.

 

SEVERABILITY

We have made every effort to ensure that these Terms of Use adhere strictly with applicable laws, legislation and regulations. These Terms of Use are the entire agreement between you and the Company regarding its subject matter. If any provision of these terms are deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity and enforceability of the remaining provisions of the remaining Terms of Use, which shall remain in full force and effect. This clause on "Severability" shall apply only within jurisdictions where a particular term is illegal.

 

REVISIONS TO THE TERMS OF USE

MWA reserves the right to update these Terms of Use to take account of changes in law, legislation or regulation or for any other reason. If we update these Terms of Use, we will post a new version on the Website and the App. You are bound by changes to these Terms of Use when you use the Website or the App after those changes have been posted. We encourage you to periodically review the Website and the App for the latest information on our privacy practices. If there is a conflict between two versions of the Privacy Policy to which you have agreed or been deemed to agree, the more recent version shall take precedence unless it is expressly stated otherwise.

 

ASSIGNMENT

MWA shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms of Use without any notification or consent required. However, you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms of Use.

 

ENGLISH LANGUAGE

In the event of a conflict between the English language version of these Terms of Use and any foreign language translation versions thereof, the English language version shall govern and control. All disputes, claims and causes of action (and related proceedings) will be communicated in English.

 

GOVERNING LAW AND JURISDICTION

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Singapore. You agree to submit to the exclusive jurisdiction of the courts of the Republic of Singapore.

 

MWA controls and operates the Website and the App from Singapore and makes no representation that these materials are appropriate or available for use in other locations. If you use the Website or the App from other locations you are responsible for compliance with applicable local laws, legislation and regulations.
